Court Finds Prassi Software USA in Contempt for Violating Order in CD Software Grievance Filed by Adaptec

Milpitas, CA, August 25, 2000 - Adaptec, Inc. (NASDAQ: ADPT), the global leader in innovative storage solutions, reported today that the United States District Court in San Jose, Calif., has found Prassi Software USA, Inc., and three of its principals in contempt of court for violating a 1998 court-ordered preliminary injunction in an intellectual property case filed by Adaptec related to its CD-R software technology.

The Court found Prassi and the individual defendants, Umberto Bassignani, Paulo Barettoni and Jeff Stenehjem, in contempt based upon post-injunction sales and distribution of the enjoined CD Right! and CD Rep products, and others derived from them. In issuing the order, the Court noted evidence that the defendants "explicitly encouraged certain licensees to continue selling and distributing enjoined products" and "continued to provide its licensees with 'new builds' of enjoined products."

Adaptec has been awarded compensatory sanctions for the contempt, including the disgorgement of what the Court described as the "significant royalties" Prassi has received for post-injunction sales and Adaptec's attorneys' fees and costs.
